Cyril "Cy" Burke Jr. was sworn in Tuesday night by Judge Francis Lawrence as Norristown Municipal Council's newest at-large council member. The position is temporary, with Burke holding the seat until a new council member is elected in November. He was appointed to the seat at special council meeting on Friday, May 3. "I feel for the short period of time that I'm going to be [here], hopefully I can do some good work," said Burke of his appointment. Burke and his wife Donna have lived in Norristown's West End for over six years. The American Civil Liberties Union has filed a lawsuit claiming Norristown's "Three Strikes" ordinance is unconstitutional and threatens the lives and safety of domestic violence victims and other tenants.
The American Civil Liberties Union (ACLU) filed a federal lawsuit against Norristown on Wednesday over the municipality's "Three Strikes" ordinance aimed at landlords whose tenants are the source of repeated police calls for "disorderly conduct or other activities that disturb or threaten the neighborhood." The ACLU charges that the ordinance is unconstitutional and "punishes innocent tenants and their landlords for requesting police assistance." The case was filed on behalf of a Norristown resident, Lakisha Briggs, a victim of domestic violence who the ACLU says faced eviction for calling police when she was being attacked by her abusive ex-boyfriend. Norristown Municipal Council meets tonight at 7:30 p.m. at Norristown Municipal Hall, 235 E. Airy Street, and among the topics on tonight's agenda will be a vote to revoke Norristown's "Three Strikes Ordinance." The ordinance was designed to give the municipality an avenue for dealing with landlords whose tenants are considered repeat offenders by police when it comes to disorderly conduct, disturbing the peace and other illegal behavior. The ordinance would require a landlord of a targeted property to develop a plan of action and could eventually result in a hearing at which the revocation of the rental license would be considered. Councilwoman DeSouza attacked the contract with municipal employees saying it doesn't hold code enforcement officers to a high enough standard and grants too many vacation days and holidays.
Council voted to approve a two-year contract with the American Federation of State, County and Municipal Employees (AFSCME) which represents municipal clerks and code enforcement and parking officers on Tuesday by a 5-1 vote. The lone dissenter was Councilwoman Dr. Mary DeSouza, who voiced her opposition to the already negotiated contract, stating that it doesn't hold code enforcement officers to a high enough standard and offers pay raises and vacation and holiday time that is too generous for the municipality's current budget. The contract is reportedly retroactive to Jan. 1, 2011 and includes 2% annual pay raises, 12 paid holidays and up to 100 days of paid sick leave time that can be accrued. Police arrived to serve a warrant on a man alleged to have assaulted his pregnant girlfriend and end up calling code enforcement to condemn the home.
Norristown Patch reported last week on the pregnant woman who was medevaced to a Philadelphia hospital after allegedly being pushed down a flight of stairs and assaulted by her boyfriend on the 900 block of Buttonwood Street on Monday, Aug. 13. According to a report from the Norristown Police Department, police returned to 925 Buttonwood Street on Friday, Aug. 17 at approximately 8:10 a.m. to execute a search warrant and arrest 29-year-old Outajiri Mays on charges of aggravated assault and related domestic violence charges. Lawyers for the municipality are expected to ask a judge to lift the order at a hearing scheduled for Thursday.
According to The Times Herald, a lawyer representing the municipality in the 770 Sandy Street condemnation matter is expected to ask the judge to lift the order at hearing scheduled for Thursday, Aug. 16, at Montgomery County Common Pleas Court. The necessary repairs and inspections were reportedly completed three months ago and have all been documented in a letter from Yerkes Associates written in late June. The state has asked the judge to impose a mandatory one-year sentence for builder Bruce Fazio, who was convicted in June of theft.
According to The Times Herald, prosecutors are asking a judge to impose a mandatory one-year sentence on Bruce Fazio, the 770 Sandy Street developer who was convicted in June of of theft by deception, theft by not making required disposition of funds and receiving stolen property in connection with the condemned property. After firefighters responded twice in the same day to the 200 block of Buttonwood Street for a tree fire, Code Enforcement officials ordered it cut down for public safety.
Twice on Thursday, Aug. 9, the Norristown Fire Department responded to the same address on the 200 block of Buttonwood Street for a large tree that caught fire and then later re-ignited again. Residents say the tree has been a constant source of worry for the neighborhood given it's size and the fact that it's completely rotted and hollowed out from the ground to about 10 feet up the trunk.
